Terms and Conditions for the Scooter Lottery
Article 1: Introduction
Purpose: These Terms and Conditions govern the Scooter Lottery (the "Lottery") organized by Fleetser.
Eligibility: The Lottery is open to individuals who meet the entry requirements outlined below.
Article 2: Lottery Details
Start and End Date: The Lottery begins on Monday, 24th February 2025, and ends 14 days later.
Entry Fee: Each entry costs €500. Entrants can purchase multiple entries to increase their chances of winning.
Article 3: Prize Details
Prize: The prize consists of 120 OKAI ES400A scooters, including:
120 scooters with batteries (73 working from 2023 and 47 needing minor maintenance from 2020/2023).
Spare parts including 11 spare batteries, 6 controllers, and 14 IoT devices as well as various parts
Target Price: The target price for the Lottery is €28,100.
Winner's Responsibilities: The winner is responsible for all costs associated with transporting the scooters, import fees, and any other related expenses.
Article 4: Conditions for Winning
Target Price Achievement: If the target price is not reached, the Fleet Owner reserves the right to retain the scooters.
Winner Selection: The winner will be selected randomly through a live stream event featuring a spinny wheel on 11th March 2025.
Article 5: Live Stream and Winner Announcement
Live Stream: The Lottery draw will be conducted via a live stream, where the winner will be announced.
Article 6: Payment and Refund Policy
Entry Payment: All entry payments are non-refundable unless the target price is not reached.
Cancellation: In the event of cancellation, Fleetser will refund all entry fees.
Article 7: Liability and Dispute Resolution
Limitation of Liability: The Fleet Owner is not liable for any damages or losses arising from participation in the Lottery, except as required by law.
Dispute Resolution: Any disputes arising from the Lottery will be resolved through negotiation. If unresolved, disputes may be referred to arbitration in accordance with applicable laws.
Article 8: Data Protection
Personal Data: By entering the Lottery, entrants consent to the collection and use of their personal data for the purposes of administering the Lottery.
Data Privacy: The Fleet Owner will handle personal data in compliance with applicable data protection laws.
Article 9: Governing Law
Jurisdiction: These Terms and Conditions are governed by and construed in accordance with the laws of Bosnia.
Court Jurisdiction: Any legal proceedings arising from these Terms and Conditions will be resolved in the courts of Bosnia.
Article 10: Changes to Terms and Conditions
Amendments: The Fleet Owner reserves the right to modify these Terms and Conditions at any time without notice.
Notification: Entrants are advised to check the official Lottery website for updates to these Terms and Conditions.
By participating in the Lottery, entrants acknowledge that they have read, understood, and agree to be bound by these Terms and Conditions.
